Update: With the solicitation text revealed, it confirms that yes, this is Damian Wayne, It does, however also confirm that those bullets are bouncing off him, saying "Damian has super powers of his own!"
So why spoil the storyline so soon? We can suppose that DC is simply banking on the excitement of Damian being back outweighing any upset over revealing it in a paragraph instead of the pages of a comic. It should boost sales of December’s “Robin Rises” chapters, as well as the January issue, of course.

The team of Batman and Robin are together again! But what is the new dynamic for this crimefighting duo now that Damian has super powers of his own?
Original Story: Writer Peter J. Tomasi decided to take matters into his own hands when he realized that DC Comics would be spoiling the big Robin Rises reveal in their solicitations today. Instead of letting them do it, he took to twitter to reveal the cover of Batman & Robin #38, hitting stores in January 2015, and revealing the new Robin.
Last Chance to Avoid Spoilers
Occasionally, we’ll see companies like Marvel Comics release solicitations with a simple “Classified,” or a blacked-out cover, or even a tease in the solicitation that says something like “___ revealed! Who is the new ____?”
DC Comics elected to go in a different direction. Yeah, SPOILERS coming, folks. Do not read further, or read the DC Solicitations for January if you don’t want to know the identity of Robin come December.
Yes, it seems that in December, Batman, Bruce Wayne will be successful in restoring his son Damian Wayne to life, and as of January, he will be Robin again. The cover to Batman & Robin #38, from the creative team of Peter Tomasi and Pat Gleason & Mick Gray, shows what looks like Damian Wayne, standing triumphantly, very much alive, and wearing the Robin costume. In fact, it sure looks like those bullets are bouncing off his chest, which certainly throws another wrench into the reveal.
